1. Agreement to Terms

Welcome to WIM Careers (“WIM,” “we,” “us,” or “our”), a career intelligence platform operated by WIM Ventures, LLC, a California limited liability company, doing business as WIM Careers. By accessing or using our website at wimcareers.com (the “Platform”), you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and WIM Careers, governed by the laws of the State of California.

2. Eligibility

You must be at least 18 years of age and legally able to enter into binding contracts under California law to use the Platform. By creating an account, you represent and warrant that:

  • You are at least 18 years old.
  • You have the legal capacity to enter into these Terms.
  • All information you provide during registration and thereafter is accurate, current, and complete.
  • If you are registering on behalf of an employer or business entity, you have the authority to bind that entity to these Terms.

3. Description of Services

WIM Careers is a career intelligence platform designed exclusively for the Architecture, Engineering & Construction (“AEC”) industry. The Platform provides:

  • For Professionals: Career profiling, credential aggregation and wallet, WIM Score (a proprietary career intelligence rating), job alignment matching, AI Career Coach, salary benchmarking, career path mapping, project contribution ledger, peer endorsement system, portfolio hosting, offer letter review and response, secure document management center, job alerts, and annual career reports.
  • For Employers: Company profile and branding, candidate discovery and search tools, job posting management, direct candidate messaging, candidate comparison tools, hiring analytics, offer letter generation and tracking, benefits package management, secure document management center, interview scheduling and pipeline management, employer hiring analytics dashboard, and placement facilitation services.

WIM is not a staffing agency, employment agency, or recruiter. WIM provides technology-enabled career intelligence tools and matching services. WIM does not guarantee employment, placement, or hiring outcomes.

4. Account Registration and Security

To access certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Maintain the security and confidentiality of your login credentials.
  • Not share your account credentials with any third party.
  • Immediately notify WIM of any unauthorized access to or use of your account.

You are solely responsible for all activity that occurs under your account. WIM shall not be liable for any loss or damage arising from your failure to comply with these security obligations.

5. User Types

5.1 Professional Users

Professional users are individuals working in or seeking employment within the AEC industry. Professional accounts provide access to career intelligence tools, profile management, job alignment, and related features based on the selected subscription tier.

5.2 Employer Users

Employer users are AEC firms, companies, or their authorized representatives seeking to discover, evaluate, and hire AEC professionals. Employer accounts provide access to talent discovery, job posting, candidate messaging, and related features based on the selected subscription tier.

6. Subscription Plans and Payment

6.1 Professional Subscription Tiers

WIM serves two industry sectors, and paid subscription pricing differs by sector. The feature set for each tier is identical across sectors; only the price changes. Prices below are shown as Architecture & Engineering / Construction.

  • Free: Access to the Platform at no cost, including your WIM Score with one full breakdown reveal, unlimited general AI Career Coaching plus one live-deal negotiation session, salary & market-value intelligence, your #1 employer match analysis in full, limited credential wallet (5 items), project ledger (3 projects), job alignment (3 per month), peer endorsement requests (2 per month), and portfolio hosting (1 project).
  • Starter ($9/month; $12/month for the Construction sector): Includes all Free features plus ongoing full WIM Score breakdown, interview prep for specific job postings, a personalized negotiation playbook, visibility across all your employer matches, boosted employer visibility with matching-firm alerts, unlimited credential wallet, unlimited job alignments, increased peer endorsement requests (10 per month), and portfolio hosting (up to 5 projects).
  • Professional ($19/month; $24/month for the Construction sector): Includes all Starter features plus unlimited live-deal negotiation coaching, offer-specific analysis, WIM Score roadmap and peer benchmarking, priority match ranking, top employer visibility with see-who-viewed-you, real-time salary and opportunity alerts, unlimited project ledger, unlimited portfolio hosting, unlimited peer endorsements, offer review & response, document center, job alerts & saved searches, and annual career report.

6.2 Employer Subscription Tiers

As with professional plans, employer pricing differs by sector while the feature set for each tier is identical across sectors. Prices below are shown as Architecture & Engineering / Construction.

  • Free: Company profile and branding, browse candidate summaries, up to 3 active job postings, receive applications, talent pool statistics, and basic search filters at no cost.
  • Contact Plan ($149/month; $189/month for the Construction sector): Includes all Free features plus full candidate profiles, up to 10 active job postings, direct candidate messaging (20 per month), advanced search filters, WIM Score visibility, enhanced company branding, offer letter generation, benefits package setup, and document center.
  • Advanced ($349/month; $449/month for the Construction sector): Includes all Contact Plan features plus unlimited job postings, unlimited direct messaging, saved searches with alerts, candidate comparison tools, hiring analytics dashboard, interview pipeline management, priority support, premium company branding, and reduced placement fee (6%).

6.3 Billing and Payment

All paid subscriptions are billed monthly in U.S. dollars. Payment is processed through our third-party payment processor, Stripe, Inc. By subscribing to a paid plan, you authorize WIM to charge your designated payment method on a recurring monthly basis until you cancel.

You are responsible for all applicable taxes. WIM reserves the right to adjust pricing with 30 days' advance notice to your registered email address.

6.4 Free Trials

WIM may offer free trial periods at its discretion. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate.

7. Cancellation and Refunds

7.1 Cancellation

You may cancel your paid subscription at any time through your account settings. Upon cancellation:

  • Your subscription will remain active until the end of your current billing period.
  • You will not be charged for subsequent billing periods.
  • Your account will revert to the Free tier at the end of the billing period.
  • Your profile data will be retained and accessible under Free tier limitations.

7.2 Refunds

Because all paid plans are month-to-month with no long-term commitment, WIM generally does not provide refunds for partial billing periods. However, WIM reserves the right to issue refunds on a case-by-case basis at its sole discretion.

7.3 Upgrades and Downgrades

Upgrades take effect immediately, with pro-rated charges applied to your current billing cycle. Downgrades take effect at the start of your next billing cycle. Your data is never deleted when changing plans.

8. Placement Fees (Employers)

8.1 Fee Structure

When an employer hires a candidate who was discovered, contacted, or matched through the WIM Platform, a placement fee applies:

  • Standard Rate: 8% of the hired candidate's first-year annual base salary.
  • Advanced Plan Rate: 6% of the hired candidate's first-year annual base salary (for employers on the Advanced subscription plan).

8.2 Attribution Window

The placement fee applies to any hire made within twelve (12) months of the employer's first interaction with the candidate on the WIM Platform, including but not limited to: viewing the candidate's full profile, sending a direct message, receiving an application, or any other form of engagement facilitated by the Platform.

8.3 Anti-Circumvention

Employers shall not attempt to circumvent placement fees by communicating with or hiring candidates outside the Platform after initial discovery through the Platform. If an employer hires a candidate discovered through WIM through any channel within the 12-month attribution window, the placement fee remains applicable.

8.4 Invoicing and Payment

Placement fees are invoiced upon confirmation of hire. Payment is due within thirty (30) days of invoice date. Late payments may be subject to interest at the rate of 1.5% per month or the maximum rate permitted under California law, whichever is lower.

9. User Content and Conduct

9.1 User Content

You retain ownership of all content you submit to the Platform (“User Content”), including profile information, resumes, project descriptions, endorsements, and portfolio materials. By submitting User Content, you grant WIM a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the Platform.

9.2 Prohibited Conduct

You agree not to:

  • Provide false, misleading, or fraudulent information on your profile or in any communication.
  • Impersonate any person or entity.
  • Use the Platform for any unlawful purpose or in violation of any applicable laws.
  • Harvest, scrape, or collect data from the Platform through automated means.
  • Attempt to gain unauthorized access to the Platform, other user accounts, or our systems.
  • Interfere with or disrupt the Platform or its infrastructure.
  • Use the Platform to send unsolicited or unauthorized advertising or spam.
  • Harass, threaten, or discriminate against any other user.
  • Misrepresent credentials, licenses, certifications, or professional qualifications.
  • Use another user's profile information outside the Platform without their explicit consent.

10. Intellectual Property

The Platform, including its design, text, graphics, logos, icons, images, software, WIM Score algorithm, AI Career Coach models, matching algorithms, and all other content and technology (“WIM Content”), is owned by or licensed to WIM Careers and is protected by United States and international intellectual property laws.

You may not copy, modify, distribute, sell, lease, or create derivative works of any WIM Content without our express written permission. The WIM name, WIM Careers, WIM Score, and the WIM logo are trademarks of WIM Careers.

11. WIM Score and Career Intelligence

The WIM Score (ranging from 0 to 100) is a proprietary career intelligence rating calculated from multiple weighted factors including profile completeness, credential portfolio, project history, peer endorsements, skill alignment, platform engagement, and career progression.

The WIM Score and all career intelligence features (including AI Career Coach recommendations, salary benchmarks, career path maps, and annual career reports) are provided for informational and guidance purposes only. They do not constitute professional career advice, employment promises, salary guarantees, or representations of a user's professional competence or value.

The WIM Score is not an “automated employment decision tool” within the meaning of any applicable law, and it is not designed, intended, or authorized to make, or to serve as the sole basis for, any hiring, screening, ranking, or other employment decision. WIM does not make hiring decisions and does not participate in any employer’s hiring decision. Employers are contractually prohibited from using the WIM Score as the sole or automated basis for any employment decision, and all hiring decisions are made solely, independently, and exclusively by employers, who remain solely responsible for compliance with all applicable employment and anti-discrimination laws.

WIM reserves the right to modify the WIM Score algorithm, weighting factors, and scoring methodology at any time without prior notice.

We want every professional and every employer to understand exactly what the WIM Score means — and what it does not mean — before relying on it.

What the WIM Score IS

  • An informational guidance signal to help you understand the strength of your professional profile.
  • A snapshot built from job-relevant factors you provide — credentials, project history, skills, endorsements, and profile completeness.
  • A tool designed to help professionals identify what to improve and to help employers organize their own evaluation.
  • One input among many — always meant to be combined with an employer’s own judgment, interviews, and due diligence.

What the WIM Score is NOT

  • It is not a hiring decision, and it never automatically accepts, rejects, screens out, or ranks anyone for a job.
  • It is not a measure of your worth, character, or competence as a person or professional.
  • It is not a guarantee or prediction of employment, interviews, salary, or any career outcome.
  • It is not an automated employment decision tool and must never be used as the sole basis for any employment decision.

The hiring decision always rests solely with the employer. WIM does not make, and cannot make, hiring decisions — the WIM Score is guidance, and the choice is always the employer’s alone.

12. AI-Powered Features Disclaimer

Certain features of the Platform, including the AI Career Coach, career DNA analysis, resume parsing, and matching algorithms, utilize artificial intelligence and machine learning technologies. While WIM strives for accuracy and usefulness:

  • AI-generated recommendations are not a substitute for professional career counseling, legal advice, or human judgment.
  • AI outputs may contain inaccuracies or may not fully account for individual circumstances.
  • Users should independently verify AI-generated information before making career, financial, or employment decisions.
  • WIM is not liable for actions taken based on AI-generated recommendations.

13. Third-Party Services

The Platform may integrate with or link to third-party services, including payment processors (Stripe), credential verification databases, and professional licensing boards. WIM is not responsible for the availability, accuracy, content, or practices of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, WIM VENTURES, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Any loss of profits, revenue, data, or business opportunities.
  • Any damages arising from your reliance on Platform content, WIM Score, AI recommendations, or career intelligence features.
  • Any damages resulting from unauthorized access to or alteration of your data.
  • Any employment or hiring outcomes, or lack thereof.

IN NO EVENT SHALL WIM'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO WIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights.

15. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WIM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WIM DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

16. Indemnification

You agree to indemnify, defend, and hold harmless WIM Careers and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Platform.
  • Your violation of these Terms.
  • Your User Content.
  • Your violation of any rights of another person or entity.
  • Your misrepresentation of credentials, qualifications, or professional information.

17. Termination

WIM may suspend or terminate your account at any time, with or without cause and with or without notice, including for violation of these Terms. Upon termination:

  • Your right to access and use the Platform will immediately cease.
  • WIM may delete your account data, subject to our data retention obligations under applicable law.
  • Any outstanding placement fees or other amounts owed to WIM shall remain due and payable.
  • Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) shall survive.

You may delete your account at any time through your account settings. Account deletion is permanent and cannot be undone.

18. Dispute Resolution

18.1 Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first contact WIM at [email protected] to attempt to resolve the dispute informally. WIM will make good-faith efforts to resolve any dispute within thirty (30) days of receiving notice.

18.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration shall take place in Los Angeles County, California. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

18.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in class action lawsuits or class-wide arbitration against WIM.

19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

20. Changes to These Terms

WIM reserves the right to modify these Terms at any time. If we make material changes, we will notify you by email and/or by posting a prominent notice on the Platform at least thirty (30) days before the changes take effect. Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes.

21. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and WIM regarding the Platform.
  • Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect.
  • Waiver: WIM's failure to enforce any right or provision shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without WIM's prior written consent. WIM may assign these Terms without restriction.
  • Force Majeure: WIM shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, labor disputes, or government actions.
  • Notices: WIM may provide notices to you via the email address associated with your account. You may provide notices to WIM at [email protected].

Acknowledgment

By creating an account or using the Platform, you acknowledge that you have read and understood these Terms of Service in their entirety, including the sections describing the WIM Score, AI-powered features, limitation of liability, and dispute resolution. You specifically acknowledge and agree that the WIM Score and all career intelligence features are advisory and informational only, that WIM does not make hiring decisions, and that all employment and hiring decisions are made solely and independently by employers.
